By accessing or using PesaPoll.com, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
If you do not agree to these Terms, you must not use the Platform.
To use PesaPoll, you must:
• Be at least 18 years of age.
• Be a resident of a jurisdiction where predictive market participation is lawful.
• Not be barred from using the Platform under applicable law.
By registering, you represent and warrant that you meet all eligibility requirements.
You must create an account to access PesaPoll's features. You agree to:
• Provide accurate, current, and complete information during registration.
• Maintain the security of your account credentials.
• Notify us immediately of any unauthorized access to your account.
• Accept responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
PesaPoll is a predictive markets platform that allows users to predict outcomes of real-world events. Users deposit funds, participate in markets by purchasing shares, and receive payouts based on market outcomes declared by AzmaPredict Tech Limited.
PesaPoll is not a gambling platform. Predictive markets involve skill, judgment, and analysis of available information.
Deposits are processed via M-Pesa through the Daraja API. Funds deposited are credited to your PesaPoll wallet and may be used to participate in markets.
Withdrawal requests are processed automatically to your registered M-Pesa number. We aim to process all withdrawals within 24 hours. We reserve the right to delay or withhold withdrawals pending verification or investigation of suspicious activity.
We may charge processing fees on deposits or withdrawals. Any applicable fees will be clearly displayed before you confirm a transaction.
When you participate in a market, you agree that:
• All participation decisions are made voluntarily and at your own risk.
• Market outcomes are declared by AzmaPredict Tech Limited and are final.
• Payouts are calculated based on the declared outcome and the shares held at the time of resolution.
• We are not liable for losses incurred through market participation.
You must not:
• Use the Platform for money laundering, fraud, or any illegal activity.
• Manipulate market prices through coordinated or deceptive trading.
• Create multiple accounts to circumvent restrictions.
• Attempt to reverse-engineer, hack, or disrupt the Platform.
• Use automated bots or scripts without prior written consent.
Violation of these prohibitions may result in immediate account termination and forfeiture of funds.
All content on PesaPoll, including but not limited to the logo, design, text, and software, is the property of AzmaPredict Tech Limited and is protected under Kenyan and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
The Platform is provided "as is" without warranties of any kind. To the fullest extent permitted by Kenyan law, AzmaPredict Tech Limited shall not be liable for:
• Loss of funds due to market participation.
• Technical failures, downtime, or data loss.
• Unauthorized access to your account due to your own negligence.
• Any indirect, incidental, or consequential damages.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
We reserve the right to amend these Terms at any time. Changes will be posted on the Platform with an updated effective date. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
